Cross Border Trends and Issues

Helmer Arizmendy, Latin America Region Head, Lombard International

Prior to the U.S. presidential election all the buzz was around moving assets and trust structures back to the US to protect the privacy of families. Following the election, and in light of pronouncements made by the Trump Administration, the focus of many families shifted to (i) visa issues and making sure their US activities and presence are compliant; (ii) accelerating the decision to apply for a Green Card or citizenship; and (iii) some concerns related to whether assets in the US could be subject to an asset freeze, thus reversing some asset flow back to Europe.  While there have been no pronouncements of pending significant changes in tax laws applicable to non-residents, many families are adopting a more conservative approach to their US tax posture.
