The FOX Executive Council '14 is comprised of CEOs of the largest, most sophisticated multi-generational family offices in the U.S. pursuing the best practices for complex family enterprises.

The purpose of this council is to elevate the professional and personal performance of these executives and therefore enhance the operation of the broader family enterprise and long term well-being of the family.

Each Council works from a FOX developed curriculum that is tailored to the needs of the Council. Meetings include content from the curriculum as well as specific topics and discussions requested by the Council members. FOX provides the appropriate internal and external resources for lively, fruitful meetings.

Tax Reform

This session will outline the latest tax developments and planning opportunities for 2018 and beyond.  Our expert speakers will comment on recent tax law changes at the time of the session and outline practical strategies for making the most of the current tax climate.  Topics were identified from a subgroup of Council members so the session covers provisions that are related to all of you.

Tax Reform Group Discussion

  • With the increase in the exemption equivalent, will you be making any large gifts soon or will you wait to use the exemption?  Are you concerned that we may see the exemption decreased by legislation before the 2025 sunset?  Do you have concerns with a claw back of the exemption if used but later reduced?
  • Impact on pass-through loss limitation rules to family offices structured as a pass through
  • Deductibility of trust expenses under the new law (i.e. trustee fees, accounting fees, taxes, etc.)
  • Meals and Entertainment expenses under the new law
  • Key planning points/ideas for wealthy individuals and trusts that have historically been AMT taxpayers
  • Impact on NII of elimination of investment expense deductions
  • More states are adopting decanting statutes or recognizing that it exists under common law.  What are the primary reasons you are considering or have done a trust decanting?  What are the best practices that you are including in the new trusts?
  • If transferring personal use real estate to multiple individuals (e.g. tenants in common, pot trust) what are the best practices for managing the common ownership?  Sample user agreements?  Thoughts on funding future operating costs?
  • Best practices for trustee selection.
  • Best practices for letters of intent from settlors or trustee guidance letters.
  • How and when to inform beneficiaries of their interest in trust.

Motivating and Retaining Talented Staff

 

The speaker plans to discuss strategies and techniques for attracting, growing and retaining talent in Family Offices. He will provide guidance on managing performance, motivating and providing sustainable career paths to Family Office staff. The unique challenges of managing the relationships between Family Office employees and family members across multiple generations will be discussed. In addition, he will present a range of competitive compensation approaches for Family Office and other small privately held businesses, including Base Salary and Incentive Compensation.  Examples and specific questions that you have regarding staff and talent at all levels will be addressed.
